Learned Counsel for the petitioner argued that the theft pertains to a mobile set from the shop and the accused petitioner was arrested after three months of the occurrence and one mobile set of Nokia made, has been recovered from his possession. Challan has been filed. The trial is likely to take quite some time. Hence the benefit of bail should be given to him.
5. In the result, this bail application under Section 439, Cr.P.C. is allowed and it is directed that petitioner Arun Kumar @ Neenu s/o. Shri. Brij Kishor shall be released on bail in FIR No.169/2007, P. S. Mundawar, District Alwar, on his furnishing a personal bond in the sum of Rs.50,000/- together with two sureties in the sum of Rs.25,000/- each, to the satisfaction of the concerned Court for his appearance before that Court on all dates of hearing and whenever called upon to do so.
