This electronic record is generated by a computer system and does not require any physical or digital signatures.

    This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the terms of use and rules and regulations, user agreement and privacy policy for access or usage of www.NearLaw.com website and/or the NearLaw app.

    ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR EXPLICIT KNOWLEDGE OF AND AGREEMENT TO ALL THE TERMS AND CONDITIONS AND RULES OF CONDUCT IN THIS AGREEMENT, THEREFORE NEARLAW.COM & NEARLAW APP & AMAZE LPPL ADVISE YOU TO PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.

  • Start and Overview

    The following terms and conditions constitute an agreement between you and Amaze Lifestyle Products Pvt. Ltd. (“NearLaw.com”, “we”, or “us”), the operator NearLaw.com and NearLaw App (“Site” or “App” or “platform”):

    1. Overview

    NearLaw.com is an online platform that connects people who require legal services or information to lawyers and other professionals who provide these services. NearLaw.com only acts as a facilitator or a platform for aggregating lawyer profiles and making them available to consumers for informational purposes. NearLaw does not advertise or solicit for legal services on behalf of the lawyers or practitioners registered on our platform. NearLaw.com does not provide any differential treatment for presenting the lawyer information to consumers, except those performance filters and sorting orders that are programmatically ordered through an algorithmic, automated process.

  • Your Agreement to Terms

    BY USING THE SITE, AND/OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THESE TERMS OF USE , including that you consent to the Privacy Policy, Disclaimer, Limited Liability Notice, Indemnity Notice, BCI Rules of Compliance Notice, No Advertising, No Solicitation Notice, all of which are incorporated herein and that you are agree to comply with applicable laws of India with the Courts at Mumbai and The Hon’ble High Court of Bombay having exclusive jurisdiction over the validity and enforcement of this agreement.

  • Definitions

    2. Definitions

    1. "Agreement" means the Terms and Conditions (T&C) contained herein, which are mandatory and non-negotiable for the use of this platform, NearLaw.com and NearLaw app. It will also include references to this Agreement as and when amended, notated, supplemented, varied or replaced.

    2. “Site” or “App” or “Platform” or “Service” means the NearLaw.com owned and operated by Amaze Lifestyle Products Pvt. Ltd., which provides a medium through its website/app platform and other affiliated sites/ landing pages/ blogs / content pages, to the users and Lawyers/ Advocates / Solicitors/ Legal Practitioner / Attorney(s) / Law Firm(s) / Law Firm Representative(s) to interact and exchange legal information that would be beneficial to the Users.

    3. “Company” means Amaze Lifestyle Products Pvt. Ltd. the company in control of NearLaw.com & NearLaw app and other affiliated sites/ landing pages/ blogs / content pages. Vikas Lal Sahita is the owner of the domain names, intellectual properties of the brand names, NearLaw.com and NearLaw and other associated wordmarks and logomarks.

    4. "Affiliate" being a corporate entity, means any entity, which controls, is controlled by, or is under the common control of the Company and being an individual, means any entity, which is controlled by the Company. Third-Party Affiliates are not controlled by the company and are separate, independent entities.

    5. “Third Party Legal Professional” or “Third Party Lawyer” refers to an external, independent entity, such as a Lawyer/Advocate/Solicitor/Legal Professional/ Attorney/ Law Firm(s) / Law Firm Representative(s) who is/are registered to perform duties as an Advocate with the Bar/ Governmental / Judicial body responsible for registered Advocates for practice in their individual jurisdictions. The terms, Lawyer, Advocate, Solicitor, Attorney, Law Firm, Law Firm Representative are used interchangeably and are meant to convey the meaning above.

    6. “User/You” means and includes any Consumer / User/ Visitor/ You (the person or any legal entity) who accesses the Site/ App/ Platform or Service.

    7. “Products” connotes the informational services available for access by Consumers on the NearLaw platform.

    We advise you to please read and understand this Agreement carefully. Further, please regularly check for any amendments or updates to the terms and conditions from time to time. NearLaw.com or NearLaw app or Amaze LPPL may add to or change or update these Terms of Use, from time to time entirely at the its own discretion without prior notice or intimation. You are responsible for checking these Terms of Use periodically to remain in compliance with these terms. Your use of the Platform after any amendment to the Terms of Use shall constitute your acceptance of the original terms and the amended terms and you also agree to be bound by any such changes/revisions.

    Any clause of these “Consolidated Terms of Use” document, if deemed invalid, void or for any reason unenforceable, shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses contained herein, or in a separate Annexure or a future modification or change or revision.

    The section titles in this Agreement are for grouping relevant clauses together (for ease of reading) only and have no legal or contractual effect whatsoever.

  • Not a Law Firm; Not Providing Legal Advice

    3. We are Not a Law Firm and We do Not Provide Legal Advice

    NearLaw.com, NearLaw app or Amaze LPPL provides a platform for legal information and self-help. The information provided by NearLaw.com, NearLaw app or Amaze LPPL along with the content on our website related to legal matters ("eJudgments”, “ActsRules", “eLawArticles” “Law Guides” etc.) is provided for your private use and does not constitute legal advice. We do not review any information you provide us for legal accuracy or sufficiency, draw legal conclusions, provide opinions about your selection of forms, or apply the law to the facts of your situation.

    If you need legal advice for a specific problem, you should consult with a Registered Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s). Neither NearLaw.com, NearLaw app or Amaze LPPL nor any Legal Information provided by NearLaw.com, NearLaw app or Amaze LPPL is a substitute for legal advice from a qualified attorney(s) / Law Firm(s) / Law Firm Representative(s) licensed to practice in an appropriate jurisdiction.     Your use of the Services does not create an attorney(s) / Law Firm(s) / Law Firm Representative(s)-client relationship between you and NearLaw.com, NearLaw app or Amaze LPPL, or between you and any NearLaw.com, NearLaw app or Amaze LPPL employee or representative. Unless you are otherwise represented by an attorney(s) / Law Firm(s) / Law Firm Representative(s), including a Participating Attorney(s) / Law Firm(s) / Law Firm Representative(s), you represent yourself in any legal matter you undertake through our Services.

    NearLaw.com, NearLaw app or Amaze LPPL is not a "Lawyer Referral Service". The directory of lawyers published on our website is provided to the public free of charge and is for informational purposes only. NearLaw.com, NearLaw app or Amaze LPPL does not endorse or recommend any attorney(s) / Law Firm(s) / Law Firm Representative(s) nor does it make any warranty as to the qualifications or competency of any attorney(s) / Law Firm(s) / Law Firm Representative(s).

  • Services provided by Third Party Lawyers

    4. “Third-Party” Lawyer/Advocate/Solicitor/Legal Practitioner/Attorney(s) / Law Firm(s) / Law Firm Representative(s) Consultation, Information / Assistance

    1. NearLaw.com is no way, directly or indirectly responsible for the information and assistance provided by the Third Parties including Lawyers / Advocates / Solicitors / Legal Practitioner / Attorney(s) / Law Firm(s) / Law Firm Representative(s). NearLaw.com & NearLaw app is an independent platform that connects people who require legal services to Verified Lawyers/ Advocates/ Solicitors / Legal Practitioners / Attorney(s) / Law Firm(s) / Law Firm Representative(s). The Users can post free questions to, or search for and contact Third Parties (Lawyers/Advocates/Solicitors/ Legal Professionals/ Attorney/ Law Firm/ Law Firm Representatives) on their own. NearLaw.com & NearLaw app only provides the platform enabling such interaction and is not responsible for the content supplied by Third Parties (Lawyers/Advocates /Solicitors / Legal Professionals/ Attorney/ Law Firm/ Law Firm Representatives) in the form of Answers to user-asked questions or the content of the interaction between Users and Third Party Lawyers. NearLaw.com & NearLaw app does not have access to and therefore has no control over the services and information provided by the Third Party Lawyers. NearLaw.com will not be responsible for any issues or claims or any disputes with regard to the interaction and service delivery between the User and the Third Party Lawyer/ Advocate / Solicitor / Legal Practitioner / Attorney(s) / Law Firm(s) / Law Firm Representative(s).
    2. Any free interaction between a User and a Third Party (Lawyer/Advocate/Solicitor/Legal Professional/ Attorney(s) / Law Firm(s) / Law Firm Representative(s)) is not subject to attorney(s) / Law Firm(s) / Law Firm Representative(s)-client privilege and is available for publishing on the NearLaw.com & NearLaw app and related blogs and parking pages and in any publication for spreading knowledge and awareness to the public at large. Personally identifiable details such as name and address shall not be shared or published. For private consultation, there are paid options, which the User can access and contact the Third Party of their choice.
    1. NearLaw.com & NearLaw app have multiple Third Party (Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)) registered with us for the purposes of accessing our Research Tools and providing Paid Consulting to Public Users. NearLaw does not “refer” or “collect any fees based on referral” or offer any advertising or solicitation on behalf of these Third Party Lawyers and does not allow such practices by any other party, whether Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s) or a Public User.
    2. The choice of which Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s) to consult depends on various factors such as “Years of Experience” “Law Area / Practice Area” (Expertise), “Court Affiliation” etc. and we endeavour to show this data transparently and openly with all Users, without any fees whatsoever. In doing so, we do not endorse or recommend any Third Party, but simply show the factual information, as provided by the Third Party Lawyers, on a self-reported basis. The order of Profiles/ Results shown on the “Find Lawyer” search page are determined by the User input and the Ratings/Reviews (user-input) and other considerations that are User-driven. In making such results, we do not provide any recommendation but merely respond to the User input. The Public User has to make the determination and choice of which Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s) s/he wishes to consult with, and then proceed accordingly.
    3. The Third Party (Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)) of your choice, which You chose to consult with, is solely responsible for providing its services to you, and you agree that NearLaw.com shall not be liable for any damages or costs of any type arising out of such interaction or in any way connected with your use of such services (including, without limitation, malpractice claims or misconduct of any kind whatsoever). You agree that any claim arising out of your interaction or relationship with Lawyers/ Advocates / Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s) shall be made solely against such Third Party, and, such claim would not be made against NearLaw.com or NearLaw app or Amaze LPPL and any of its managers, owners, directors, employees, partners or affiliates.
  • Basic Rules of Operation

    5. Basic Rules

    The agreement between you and NearLaw.com / NearLaw app / Amaze LPPL is subject to the following terms and conditions :-

    · The User certifies that he/she is at least 18 (eighteen) years of age and is an Adult in the jurisdiction of his/her residence.

    · Wherever applicable, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of NearLaw.com / NearLaw app / Amaze LPPL you expressly consent to the rules, regulations and terms set forth in this agreement and the Terms and Conditions.

    · NearLaw.com / NearLaw app / Amaze LPPL grants the User a limited, non-transferable license to use NearLaw.com / NearLaw app / Amaze LPPL in accordance with the terms and conditions of this Agreement. The User may only use the Site to make legitimate inquiries, book consultations with Third-Party Lawyers/Advocates/ Solicitors/ Attorney(s) / Law Firm(s) / Law Firm Representative(s)/ Legal Practitioner and shall not use the Site for any other purposes, including without limitation, to make any speculative or fraudulent reservation or any reservation in anticipation of demand or any other purposes.

    · All prices, unless indicated otherwise are in Indian Rupees.

    · Once the User accepts and confirms his/her intention to book any Third-Party Consultation offered on the Site, User is obligated to complete such transactions. Users shall prohibit from indicating its acceptance to book Third-Party services where s/he does not intend to complete such transactions.

    The user agrees to receive unlimited messages with regards to their transaction or purchase order from NearLaw.com / NearLaw app / Amaze LPPL. This clause shall survive till the expiry or termination of this User Agreement. Use of NearLaw.com / NearLaw app / Amaze LPPL is governed by our “Privacy Policy”, which can be located at https://nearlaw.com/terms/lawyer_terms.html#privacy_policy

  • Consulting Options

    6. Consulting Options on NearLaw.com & NearLaw app

    NearLaw.com & NearLaw app offers 3 options or use cases for every user:

    1) Free Question:

    a. A Public User can post a Free Question on NearLaw.com, for which no money will be charged from the User. Free Questions will be posted on the Public platform on NearLaw.com & NearLaw app & other platforms (as indicated by the User) for All Third Party Legal Professionals to review and answer, at their convenience and as per their choice and sole discretion.

    b. Free Questions might not get answers, so there is no guarantee or certainty of receiving an answer. Also, answers may be delayed based on availability of time with Third Party Legal Professionals (who are Independent Parties). If an immediate response is required, the “Paid Consultation” might be a better option.

    c. Answers to Free Questions are not confidential and will be shown on the platform to help others in the same situation. These answers do not fall under the purview of attorney(s) / Law Firm(s) / Law Firm Representative(s)-client privilege and by using the “Free Question” or “Ask Question” feature, you agree to indemnify and defend us and free us and the platform of violating any attorney(s) / Law Firm(s) / Law Firm Representative(s)-client or lawyer-client relationship that you believe, erroneously, that you have a claim or right to.

    d. Free Questions may be answered by any registered Third Party Legal Professional. You do not have the choice to select your preferred Legal Professional. The Lawyer or Legal Professional may choose NOT to answer your question with or without assigning a reason for the same. You will be intimated in such cases via email and / or phone message.

    e. NearLaw.com is no way, directly or indirectly responsible for the information in the “Free Questions” and “Answers” provided by the Third Party (Lawyer / Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)), in any way or form whatsoever and is not liable for any loss or adverse outcome or circumstance whatsoever arising out of any action/interaction between you and the Third Party (Lawyer / Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)).

    2) Paid Consultation:

    a. For consulting a Third Party Legal Professional, you can choose a Paid Consultation via:

    i. Email: You can send the Third Party Legal Professional 3 Emails and get 3 Responses. You can ask questions and follow-up questions related to a single matter and not ask about multiple matters. Fees paid is for the Third Party Legal Professional’s fees and NearLaw.com or NearLaw app or Amaze LPPL does not receive any part of the fees.

    ii. Phone: You get to speak with a Legal Professional for 30 minutes as per their availability schedule. This will happen over the course of the next 5-to-7 days. You have to bear the cost of the mobile phone outgoing call tariff. Fees paid is for the Third Party Legal Professional’s fees and NearLaw.com or NearLaw app or Amaze LPPL does not receive any part of the fees.

    iii. Face-to-Face Meeting / Physical Meeting: You may meet the Lawyer for a period of 30 minutes, at their designated office or workplace. You will have to travel to the place specified by the Third Party Legal Professional / Lawyer / Advocate / Solicitor / Attorney(s) / Law Firm(s) / Law Firm Representative(s) and bear the costs of travel yourself. Fees paid is for the Third Party Legal Professional’s fees and NearLaw.com or NearLaw app or Amaze LPPL does not receive any part of the fees.

    b. NearLaw.com is no way, directly or indirectly responsible for the information and assistance and services provided by the Third Party (Lawyer / Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)), in any way or form whatsoever and is not liable for any loss or adverse outcome or circumstance whatsoever arising out of any action/interaction between you and the Third Party (Lawyer / Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)).

  • No Advertising or Solicitation by Lawyers

    7. No Advertising by Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s); No Solicitation by Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)

    NO Advertising ; NO Solicitation by Any Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) on NearLaw.com/ NearLaw App

    NearLaw.com & NearLaw app is fully compliant with Rule 36 of Section IV “Duty to Colleagues” of Chapter II of Part VI of the Rules; it is clearly mentioned as under:

    “An advocate shall not solicit work or advertise, either directly or indirectly, whether by circulars, advertisements, touts, personal communications, interviews not warranted by personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with cases in which he has been engaged or concerned.”

    Therefore, NearLaw.com & NearLaw app does not allow and expressly prohibits the use of any advertising or solicitation by any Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) whether by means of information contained in an answer, response, article, update or any other content posted on the platform/app or in any interaction with any entity through the platform, the same shall be prohibited and if any Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s), who is found to be in violation of this Rule/ Compliance requirement of Bar Council of India, will be required to discontinue use of the NearLaw.com platform & NearLaw app, and whose account privileges will stand permanently disabled and terminated, without advance notice or intimation. No liability, or claim or action shall be initiated against NearLaw.com / NearLaw app due to the aforementioned actions since they are required by us to be done to be compliant with the said law of the land, as ordained by the statutory body, the Bar Council of India.

    Post initial contact by the Public User, any follow-up communication and interaction, even when initiated by the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s), will not fall under the purview of “Advertisement” or “Solicitation” and such actions would have to be self-regulated by the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) and the terms and scope of such interaction shall be determined directly between the User and the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s).

    Any and all contact by Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) with Users, which is initiated or takes place without the involvement or on a platform other than NearLaw.com/ NearLaw app, does not come within the scope of these Consolidated Terms of Use.

    All registered Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) are responsible to the Bar Council of India (or the respective State Bar Councils, as the case may be) for their own compliance and certification/registration guidelines and NearLaw.com / NearLaw app specifically disclaims any liability and you agree to indemnify and defend NearLaw.com/ NearLaw app against any claims or cases or actions made out against us in respect of any disallowed or misconduct or malpractice or violation or lack of compliance or disrespect of any Bar Council of India rules, regulations and resolutions and future amendments, or Advocate Act rules and regulations and future amendments, including but not limited to conduct unbecoming of an Advocate, any punitive damages, monetary claims, civil or criminal litigation or any other cause of action brought on NearLaw.com/ NearLaw app due to conduct of any Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s).

    No Sponsored Listings by Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)

    NearLaw.com, NearLaw app & Amaze LPPL, though an open and accessible Lawyer Directory which aims to have numerous Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s), among its Third Party members. Our platform does not allow sponsored listings wherein a service provider is listed purely on the basis of monetary consideration paid for the primary space of a platform or for receiving top place in the searches performed by users. Both our listing process and search functionality are based on User actions and inputs and automated algorithms that compute user and third party action stream and activity history on the platform and is not guided by any consideration received by any Third Party Lawyers towards this purpose.

    No endorsements or recommendations of any Third-Party Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)

    NEARLAW.COM & NEARLAW APP & AMAZE LPPL DOES NOT ENDORSE OR RECOMMEND OR ADVERTISE OR PUBLICISE ANY THIRD PARTY LAWYER / ADVOCATE / SOLICITOR / LEGAL PROFESSIONAL / ATTORNEY(S) / LAW FIRM(S) / LAW FIRM REPRESENTATIVE(S), ON OUR PLATFORM IN ANY WAY OR FORM. THEREFORE WE ARE NOT TO HELD LIABLE TO YOU OR ANYONE ELSE FOR ANY ACTION OR ADVERSE CIRCUMSTANCE OR SITUATION AS A RESULT OF SUCH ACTION TAKEN BY YOU IN RELIANCE ON ANY INFORMATION, INCLUDING BUT NOT LIMITED TO THIRD PARTY PROFILES.

  • Independent Parties

    8. Lawyers/ Advocates/ Solicitors / Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s)s are Independent Parties

    When you use our Services, you will have the opportunity to initiate contact with an independent Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) who has registered on the platform. These Third-Parties, i.e. Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)s are neither employees nor agents of NearLaw.com, NearLaw app or Amaze LPPL. Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)s are third-party independent contractors who are responsible for their own malpractice insurance and have agreed to provide online answers, limited consultations or other basic legal services to the Users directly, without any relation to NearLaw.com or NearLaw app or Amaze LPPL.

    Communicating with a Third-Party Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) through NearLaw.com, NearLaw app or Amaze LPPL is NOT required. However, if you choose to communicate with a Third-Party Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) through NearLaw.com, NearLaw app or Amaze LPPL, please note the following:

    · When you contact a Third-Party Lawyer/ Advocate/ Solicitor/ Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) through NearLaw.com, NearLaw app or Amaze LPPL, he or she may provide you with an initial consultation, legal review of your forms or documents, or answers to your legal questions.     1. Answering questions is a great way to show your expertise and knowledge in that specific area of the law, to which the question belongs. Any follow-up to the answer needs to be dealt with, through paid consultation, via phone, email or face-to-face.

    2. NearLaw.com & NearLaw app does not permit advertising or solicitation of any kind, while answering User questions or doing any activity whatsoever through the platform/ app.

    3. Abbreviated answers such as “I agree”, “I disagree” or simply put, the conclusion of your answer will not suffice as a comprehensive answer. Kindly endeavour to address the issue and circumstances of the question and address these in a orderly and extensively. Even though the question might be complicated and may need a paid consultation, it would be appropriate for you to provide a detailed response and then indicate the option to hire a Lawyer/ Advocate / Solicitor / Legal Professional for the specific matter.

    4. Do not post any contact information of any kind whatsoever, when answering questions, since this will put you at risk for considering to be soliciting or advertising your services (which is not allowed or permitted on the NearLaw.com & NearLaw app platform). Any Lawyer / Advocate / Solicitor / Legal Professional, found to be indulging such practice, would have their account blocked, as a precaution to maintain adherence to Bar Council of India Rules and The Advocates Act.

    5. Tone of your answer should be direct, frank and fact-based. Cite the relevant Acts/Statutes and Other information / Case-law, as required. You’re free to use eJudgements to cite case-law while providing answers. Do not include any commercial undertones in your message. Do not encourage or in any way or form, indicate that the user should contact you directly.

    Rules of Conduct – “User Reviews & Ratings” feature:

    1. User reviews complete the feedback loop that ensure users can discover and select the Right Lawyer/Advocate/Solicitor/Legal Professional for their specific legal problem or question.

    2. Information that would be helpful to include in a review:

    a. Your specific experience

    b. Your feedback for what would have made the interaction better

    c. No names and personally identifiable information needs to be disclosed in the review

    d. Only factual and objective information regarding the Interaction (Initial Consultation interaction) needs to be mentioned. No hearsay, rumours or information that is obtained from a second-hand source, who did not consult with the said Legal Professional is allowed.

    e. NearLaw.com & NearLaw app & Amaze LPPL are not going to verify, prove or disprove your review, since the review belongs to the User and any disputes arising from the said review/ rating will be between you and the Lawyer/ Advocate / Solicitor / Legal Professional, so it is your responsibility to defend your review, both ethically and legally.

    3. No objectionable or inappropriate or illegal content of a libellous or mala fide nature will be tolerated and the same shall be promptly deleted and the User account may be suspended, with immediate effect, without advance notice or intimation.

    4. For the disclaimer and indemnity for any user-content including Reviews, please see the “ Limited Liability Disclaimer ” and “ Indemnity ” clauses (which can be accessed on https://www.nearlaw.com/lawyer_terms.html )

    The Third Party information of every Registered Lawyer/Advocate/Solicitor/Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) is stored in their own AdvocateProfile TM . The AdvocateProfileTM is a requirement for NearLaw.com & NearLaw app conforms to Bar Council of India Rules and is as per Rule36 of Section IV of Chapter II of Part VI of Bar Council of India Rules.

    AdvocateProfileTM is the required record of the public directory for gaining access to NearLaw platform information and users. We may contact you by email or phone to verify the contents of your AdvocateProfile, in an effort to verify your status as a licensed legal practitioner. You may edit some information which would be amenable to change such as your Court affiliation and physical address. However certain information such as Name and Advocate Code/ Practice License Number is not subject to change. You agree to provide accurate information in your AdvocateProfileTM, and to check in every few weeks to ensure the data is up-to-date and accurate.

    AdvocateProfileTM also contains record of usage of our research tools and the eConsulting record of activities. NearLaw.com reserves the right to access and develop analytics with this data, while maintaining its security. In the interest of optimizing storage space on our servers, we may delete or archive some records, from time to time.

  • User and Lawyer Communication

    13. User and Third-Party (Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)) Communication

    Third Party Legal Professionals agree to the following Communication protocols, regarding the receipt of email newsletters, mobile messaging, social network messaging, other digital communication and printed media:

    1) NearLaw.com or NearLaw app may send you information related to legal research that is relevant to your Law Area (Practice Area) multiple times in a week, as and when there is a relevant update for our Law Library ( eJudgementsTM, ActsRulesTM, or eLawArticles)

    2) Transactional information, related to Consulting requests may be sent to you, unlimited times and as per the User’s contacting you and based on the user behaviour.

    3) NearLaw.com or NearLaw app may send you messaging on mobile or email or other digital or print medium that provides legal information related to the practice of law, legal news and other general information.

    4) From time to time, we might send reminders for you to update your contact information or other data or to complete your profile, in order to make your AdvocateProfile visible to public at large. This does not equate to any endorsement or any advertising of any sort whatsoever.

    Third Party Legal Professionals agree to the following Communication protocols, regarding the receipt of email newsletters, mobile messaging, social network messaging, other digital communication and printed media:

    1) NearLaw.com or NearLaw app may send you information related to legal guides or how-to’s texts that is relevant to your Free Question or the browse activity stream on our platform. Few times in a week, as and when there is a relevant update for our Law Library ( eJudgementsTM, ActsRulesTM, or eLawArticles or Law Guides), we may send you an update.

    2) Transactional information, related to Consulting requests may be sent to you, unlimited times and as per the Legal Professional’s response to you and based on the Legal Professional’s communication preferences.

    3) NearLaw.com or NearLaw app may send you messaging on mobile or email or other digital or print medium that provides legal information related to the practice of law from the layman/ consumer’s perspective, legal news and other general information.

    The information in the newsletters or mobile messages or printed media may contain Third party (other entity) sources and we do not offer any warranties of any kind and are not liable for the veracity of such content.

    NearLaw.com and NearLaw app does not allow Lawyers, Advocates, Solicitors or Legal Professionals who are registered on the platform to solicit work or advertise, either directly or indirectly, through our platform or by sending or distributing circulars, advertisements, touts, personal communications, interviews to our Users, wherein such media of communications are not warranted by personal relations.

    Bar Council of India (BCI), a statutory body (formed under S.4 of the Advocates Act, 1961) which is the representative body of Indian bar which is responsible for laying down standards of professional conduct and etiquette for advocates in India has amended The Bar Council of India Rules – Part 6 – Chapter II as under*:

    If NearLaw or NearLaw app or Amaze LPPL hereto is prevented in the performance of any act required hereunder by reason of act of God, fire, flood, or other natural disaster, malicious injury, strikes, lock-outs, or other labour troubles, riots, insurrection, war or other reason of like nature not our fault in performing under this Agreement, then performance of such act shall be excused for the period of the delay and the period of the performance of any such act shall be extended for a period equivalent to the period of such delay except that if any delay exceeds six months, then the Legal Professional / User entitled to such performance shall have the option to terminate this Agreement.

    NearLaw.com or NearLaw app or Amaze LPPL is not liable for failure to perform our operations or discharge any obligations since such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

    NearLaw.com or NearLaw app or Amaze LPPL may terminate this Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this portal or your failure to comply with these terms and conditions. Such termination shall not affect any right to relief to which NearLaw.com or NearLaw app or Amaze LPPL and Independent Third Party Lawyers may be entitled, at law or in equity. Upon termination of this User Agreement and these terms and conditions, all rights granted to you will terminate and revert to NearLaw.com or NearLaw app or Amaze LPPL and the Independent Third Party Lawyers, as applicable

    Some Provisions Survive Termination. All provisions of this Agreement which by their nature should survive termination will survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

    No Resale of Service

    You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the content, business model, intellectual property, process or procedure of NearLaw.com, NearLaw App or its’ other products, parking pages, content or use or access to Third Party content or services.

Ltd.’s did not collect the payment for such services directly, the maximum liability for NearLaw.com & NearLaw app and Amaze Lifestyle Products Pvt. Ltd.’s shall be zero/ nil.

    In the scenario where the consumer has prepaid to NearLaw.com or NearLaw app for the service provided by the Lawyer/ Advocate/ Solicitor / Legal Practitioner (Third Party), and in the event of non-delivery of the third-party services to the consumers, since NearLaw.com & NearLaw app and Amaze Lifestyle Products Pvt. Ltd.’s collected only the payment for such services directly, the maximum liability for NearLaw.com & NearLaw app and Amaze Lifestyle Products Pvt. Ltd.’s shall extend only to the refund of the exact amount paid by the user for the purchase of the Initial Consultation (First Paid Contact) between the User and the Third Party(Lawyer/Advocate/Solicitor/Legal Professional) and will not extend to any future transactions between the User and the Third Party (Lawyer/Advocate/Solicitor/ Legal Professional), whether or not NearLaw.com, NearLaw App or Amaze LPPL is privy to the exchange or transaction.

    In any event, it is expressly clarified and explicitly understood to be agreed by the User and the Lawyer/Advocate/Solicitor/ Legal Professional that under either or any other scenario than stated above, NearLaw.com & NearLaw app and Amaze Lifestyle Products Pvt. Ltd.’s liability to any and all claims will only be up to a maximum amount of what the User was charged by the Third Party (Lawyer/Advocate/Solicitor/ Legal Professional) for the Initial Consultation (First Paid Contact) and will not extend to any future transactions between the User and the Third Party (Lawyer/Advocate/Solicitor/ Legal Professional), whether or not NearLaw.com, NearLaw App or Amaze LPPL is privy to the exchange or transaction.

  • Indemnification

    You agree to indemnify and defend NearLaw.com & NearLaw app and Amaze LPPL and its affiliates, partners, distributors and their officers, directors, employees and agents from and against any claim, recoveries, losses, damages, fines, penalties, cause of action or demands, including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein or by Third Party Lawyers as a result of your use of NearLaw.com & NearLaw app & Amaze LPPL.

    Lawyers/Advocates/Solicitors/ Legal Professionals and other Third Parties and Affiliates also agree to indemnify and defend NearLaw.com & NearLaw app and Amaze LPPL and its affiliates, partners, distributors and their officers, directors, employees and agents from and against any claim, recoveries, losses, damages, fines, penalties, cause of action or demands, including any cause of action under the Advocates Act, or BCI Rules or other third-party or governmental action, and including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein or by Third Parties as a result of your use of NearLaw.com & NearLaw app & Amaze LPPL.

    Under no circumstances, including negligence, shall NearLaw.com including (it’s Affiliates) or anyone else involved in creating, producing or distributing NearLaw.com Services be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use NearLaw.com Services, or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to NearLaw.com records, programs or services. This paragraph shall apply to all content and functionality of NearLaw.com Services.

    Notwithstanding the above, the Consumer's exclusive remedies for all damages, losses and causes of actions whether in contract, including negligence or otherwise, shall not exceed the aggregate amount, which the Consumer paid directly to NearLaw.com for the service in question. Such limitations shall apply to NearLaw.com total liability, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation of transmission, communications failure, theft of destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

    In no event shall NearLaw.com nor any of its affiliates be liable for any direct damages in excess of the purchase price for the product. In addition, to the maximum extent permitted by law, in no event shall NearLaw.com nor any of its affiliates be liable for any special, punitive, indirect, incidental or consequential damages, including but not limited to personal injury, wrongful death, loss of use, loss of profits, interruption of service or loss of data, whether in any action in warranty, contract, tort (including, but not limited to negligence or fundamental breach), or otherwise arising out of or in any way connected with the use of, or the inability to use, this website or any service offered through this website or any material or information contained in, accessed through, or products purchased on this website, even if an authorized representative of NearLaw.com is advised of the likelihood or possibility of the same. To the extent certain jurisdictions restrict any of the above limitations of liability; such limitations shall not apply in such jurisdictions to the extent of such restrictions.

    Third Party Protection

    The indemnification and disclaimers provisions set forth above are for the benefit of NearLaw.com and its affiliates and Third Party Lawyers (including but not limited to Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s)). Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you, the Consumer on its own behalf.

  • Jurisdiction

    20. Jurisdiction

    This Agreement constitutes the entire understanding between NearLaw.com, NearLaw app & Amaze LPPL, on one part, and the User, on the other part, and is being executed in the jurisdiction of Mumbai, India and shall be governed by the applicable laws of the Republic of India. Any dispute with regards to this “Consolidated Terms of Use” shall be subject to the exclusive jurisdiction of the appropriate Courts in Mumbai with Appellate and Original jurisdiction with The High Court of Bombay.

    Failure to exercise or enforce any clause in this Agreement shall not be construed as a waiver thereof. If any clause is found to be inadmissible or unenforceable due to applicable or future amendments in applicable law, the severity of that clause shall not prevent the continuity legality of the entire agreement with all of the clauses, except the inadmissible or unenforceable clause.

    However, if NearLaw.com, NearLaw app & Amaze LPPL is not able to resolve a dispute after verbal and written communication of an informal nature, then as a condition to your use of the Services we mutually agree to resolve such dispute through binding arbitration of a sole arbitrator, to be appointed at Mumbai, India, subject to the Laws of the Republic of India, with sole jurisdiction within the jurisdiction of The Courts at Mumbai and The Hon’ble High Court of Bombay. To avail of the arbitration proceedings, you, as the party seeking arbitration, are required to file a notice of dispute and send it to us via registered post. Email or other electronic communication will not be considered a valid notice of dispute.

    Any notice to NearLaw.com, NearLaw app & Amaze LPPL should be addressed to Attn: General Counsel, NearLaw.com, Amaze Lifestyle Products Pvt. Ltd, 404 Makhija Arcade, 35th Road, TPS III, Khar West, Mumbai 400052. Any notice that we may send to you will be sent to the address you entered into our system upon registration/ sign-up activity, or any other legal mailing/ residential/ office address that we are able to ascertain as your legal address.

    If you have any disputes of a legal nature or those that require governmental or judicial intervention, you may only resolve those disputes directly with the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney(s) / Law Firm(s) / Law Firm Representative(s) directly and individually, without any reference or involvement of NearLaw.com, NearLaw app or Amaze LPPL whatsoever and furthermore, you may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action against NearLaw.com or NearLaw app or Amaze LPPL for such disputes or any other disputes whatsoever. Class arbitrations, class actions, private attorney(s) / Law Firm(s) / Law Firm Representative(s) general actions, and consolidation with other arbitrations aren't allowed, and each dispute or issue has to be resolved and addressed individually and via the process outlined herein.

    Notwithstanding our agreement to arbitrate our disputes through a sole arbitrator as described above, the following assertions are made by NearLaw.com, NearLaw app, Amaze LPPL regarding the resolution of disputes between us:

    · NearLaw.com, NearLaw app & Amaze LPPL may bring a lawsuit against you in any court of competent jurisdiction (i.e. Mumbai) solely for injunctive relief to stop any unauthorized use or abuse of the Services without first engaging in arbitration or the informal dispute-resolution process described above.

    · NearLaw.com, NearLaw app & Amaze LPPL may bring a lawsuit against you in any court of competent jurisdiction (i.e. Mumbai) solely for injunctive relief to stop any intellectual property infringement without first engaging in arbitration or the informal dispute-resolution process described above.

    · In the event that the agreement to arbitrate provided herein is found to be inapplicable or unenforceable for any reason, then as a condition to your use of the Services we agree that any consequential judicial proceedings will be brought exclusively at the Courts of Mumbai city, with original/ appellate jurisdiction to be exclusively processed at The High Court of Bombay. Your acceptance of these “Consolidated Terms of Use” indicate your express consent and absolute agreement to the venue and personal jurisdiction of the courts therein.

    NearLaw.com, NearLaw app & Amaze LPPL may, in the future, make changes to these provisions regarding dispute resolution and arbitration without providing advance notice or intimation, by simply updating the edited or modified or updated or altered versions of these “Consolidated Terms of Use” to the website/ platform / app. If you do not agree with any change/ modification/ alteration / update to these “Consolidated Terms of Use”, you are free to terminate your account by sending us written notice at our registered address mentioned above. Such notice must be given within thirty (30) calendar days of the notice of any modification/alteration / change / update and must be sent to our registered address, mentioned above. You also agree to allow NearLaw.com, NearLaw app & Amaze LPPL thirty (30) days after receiving the notice of termination from you, to be in a position to start processing the request for termination, which would be completed within a period of 60 (sixty) days after receiving the intimation of termination.

  • Assignment

    22. Assignment

    NearLaw.com or NearLaw app or Amaze LPPL may choose to assign this Agreement in its entirety or parts of it to any parent, subsidiary, or any affiliated company, or as part of the sale to, merger with, or other transfer of our company to another entity. While doing so, we will do our best to inform the Third Party Lawyers and Users through an online notice regarding the same, so you can make your own determination regarding continued usage or termination. You may not assign, transfer or sublicense these Consolidated Terms of Use to any other entity under any circumstances and any attempt to do will result in violation of our Agreement and will be rendered null and void.

  • Waiver & Severability

    23. Waiver and Severability of Terms

    Our failure to enforce a provision is not a waiver of our right to do so later. If a provision is found unenforceable by the Court of Law or Government Authority/Tribunal, the remaining provisions of the “Terms of Use” will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. NearLaw.com or NearLaw app or Amaze LPPL may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services

    24. Bar Council of India Rule Compliance

    All Third-Party Lawyers/ Advocates/ Solicitors/ Legal Professionals / Attorney(s) / Law Firm(s) / Law Firm Representative(s), as a pre-condition to their registration/sign-up on NearLaw.com or NearLaw app has to conform and agree to conduct himself/herself as per the Bar Council of India Rules and Regulations (and Resolutions) and also the Advocates Act and its amendments. You also agree to the “ No Advertising and No Solicitation” notice and the “ Compliance to Bar Council of India Rules of Professional Conduct & Etiquette ” statement, attached herein.

NearLaw.com does not have, and will not accept, any responsibility or obligation or requirement of confidentiality with respect to any communications other than those expressly stated in this Privacy Policy and NearLaw.com’s Consolidated Terms of Use.

    As per Bar Council of India laid down Rules and the Advocates Act, NearLaw.com upholds the highest ethics and Code of Conduct for Lawyers signing up for our platform. Lawyers agree to NearLaw’s value proposition to be a subscription service and not an advertising/ referral service. NearLaw.com is an information platform that connects consumers requiring legal services and information to lawyers who can provide those services. For maintenance of our platform, we charge a separate fee to the users. NearLaw.com does not operate on any commission or arbitrage model. The platform fee is a transparent and nominal charge to maintain business operations.

    Lawyers need to understand that usage of NearLaw.com does not guarantee any user consultation. Answering free user questions does not guarantee user conversion to consultation. NearLaw.com makes every effort to match and connect the right lawyer to every user with a legal problem or issue. However, NearLaw.com does not advertise or refer users selectively to any one lawyer or set of lawyers.

    NearLaw.com uses automated algorithms to predict the order in which Lawyer names and profiles are sorted for a particular search. User behaviour and actions are a key aspect in determining which Lawyer Profiles are shown to the user for asking questions or requesting for an initial consultation.

    To protect against the loss, misuse and alteration of the information under our control, we have in place appropriate procedures. A pre-condition for asking “Free Questions” for which no consideration is required, is that all information regarding the question and the answer would be made public and is for the benefit for all who might be in need of information to solve similar issues or problems. Any information, not shared in the initial interaction, can only be shared within the scope of the Consultation and may not be shared, once the timeline of the Consultation expires or is deemed to be expired, in the sole discretion of the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional/ Attorney(s) / Law Firm(s) / Law Firm Representative(s), as s/he is in a position to perceive such a time and effort designation.

    § Third-Party Lawyer/ Advocate / Solicitor / Legal Professional/ Attorney(s) / Law Firm(s) / Law Firm Representative(s) does not need to do any follow-up or representation in any forum/ Court of Law or any judicial commission or any other forum.

    § Exclusions

    · No court appearances are covered under Paid (Initial) Consultations.

    · No documentation or preparation of any drafts or reading/writing fees are covered.

    · No other work, except the application of mind to the pre-submitted information and a generic form of informed plan of action as to what could be the remedy for the situation or topic or issue faced by the User, which would be dependent on the nature of the said topic/ issue and the information provided by the User himself/ herself , prior to the study of the said topic/ issue by the Third-Party Lawyer/ Advocate / Solicitor / Legal Professional/ Attorney(s) / Law Firm(s) / Law Firm Representative(s).

    · Complicated constitutional matters or matters of appeal or serious matters that have reached the Higher Courts and require application of mind for a far greater time and a serious involvement of time and effort, far greater than what is defined in the Consultation timeframe.

Ltd.’s collected only the payment for such services directly, the maximum liability for NearLaw.com & NearLaw app and Amaze Lifestyle Products Pvt. Ltd.’s shall extend only to the refund of the exact amount paid by the user for the purchase of the Initial Consultation (First Paid Contact) between the User and the Third Party(Lawyer/Advocate/Solicitor/Legal Representative) and will not extend to any future transactions between the User and the Third Party (Lawyer/Advocate/Solicitor/ Legal Representative), whether or not NearLaw.com, NearLaw App or Amaze LPPL is privy to the exchange or transaction.

    “An advocate shall not solicit work or advertise, either directly or indirectly, whether by circulars, advertisements, touts, personal communications, interviews not warranted by personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with cases in which he has been engaged or concerned.”

No liability, or claim or action shall be initiated against NearLaw.com / NearLaw app due to the aforementioned actions since they are required by us to be done to be compliant with the said law of the land, as ordained by the statutory body, the Bar Council of India.

    Any and all contact by Third-Party Lawyer/ Advocate / Solicitor / Legal Professional / Attorney / Law Firm(s) / Law Firm Representative(s) with Users, which is initiated or takes place without the involvement or on a platform other than NearLaw.com/ NearLaw app, does not come within the scope of these Consolidated Terms of Use.
